    Hi Aaron,

Confirming receipt of both your emails today.

The URL you’re referencing (“Sheriff department”) in the first email is a completed request.

The list of 3 “Open” requests you mentioned comes from the list given in our email in December, 2018 for Buncombe County Sheriff’s Office. For organization’s sake, this email from you today will be posted to that “Open” request thread.

I’d also like to state to our users that your emails today refer to multiple requests on our site. If you don’t mind, I’d like to address each one individually, on the email thread for the specific request it relates to, just so that I can keep those conversations inline with the request it relates to and the related updates I’ll need to publish on our site. This prevents us from having to respond in multiple places and post multiple updates on different requests to link them back together.

With that in mind, I’d like to reply to your message in two parts. I’ll send a reply to the other two requests you’re referencing in your other email in a moment.

    RE: 3 open requests –

From the list of follow ups we were working on a few weeks ago when we started communicating in December, there are 4 open requests. Those are:

    (Open) Buncombe County Sheriff’s Office
    (Open) Sheriff Dept employee salaries (July 1st 2016 – June 30th 2018)
(Open) Buncombe County Sheriff’s Office Sexual Assault Calls for Service
(Open) Buncombe County Sheriff’s Office Domestic Violence Calls for Service
(Completed) Buncombe County Sheriff Citizen Advisory Committee
    (Completed) Buncombe Sheriff Squad Deployments
(Completed) Buncombe County AntiCrime Task Force
    (Completed) Sheriff office Buncombe County
    (Completed) Sheriff department
(Completed) Buncombe County Sheriff’s Reserve Deputy Policy
(Completed) Buncombe County Sheriff’s Office Personnel Advisory Board

Beyond that list, there are other newer requests that are “Open” related to the Sheriff’s department, but those are not related to the list we’re discussing here, and we will continue to follow up on those individually.

We will reply to your other email momentarily, on the thread related to those other two requests mentioned.

    Thanks Aaron!

    Hi.

Just trying to make sure I’m tracking open requests properly.

Looks like there are three open requests as of today 2/1/2019?

    Is that correct?

    Hi Aaron,

Yes – Today, we will be sending follow ups on each of the Sheriff Office related requests we listed. As we reply to each of those, we’ll do it as a “Forward” to you so you can see the original message, and we’ll include the name / URL as well.

Due to the volume of requests we receive (and being a very small team), we’re trying our best to stick to a rotation process with the follow ups, and like to keep each one organized by only discussing it on the same email thread which it was sent. In our experience, it can be tricky to note all the updates on our site if things get confusing when numerous requests are being discussed in one email.

On this email chain though – The request you’re replying to right now is from May, 2018, called “Buncombe County Sheriff’s Office” https://www.sunshinerequest.com/records_request/buncombe-county-sheriffs-office/. Please continue to answer that request on this current email thread. Thank you!

    Have a great afternoon!

    Hi Aaron,

Thank you for your reply, and thank you for the information regarding who we should contact from hereon related to these Sheriff’s Office type requests.

This emails serves as confirmation of both of your emails sent to Sunshine this afternoon.

Noted, that we will reach out to you directly to follow up on each of the requests, and we will contact you with any new Sheriff’s Office type requests as they are received.

If you don’t mind, we’d like to continue to follow up on those “Open” requests we listed individually, in the email thread which they were sent. However, we will make a point to restate the name of the request we’re referring to in the email, and we will leave out all other folks in the CCs, unless it ever becomes necessary to add in someone else.

    Thank you for your assistance.

    Have a great evening!

    Hi Randy,

    Thank you for your reply.

It sounds like there may be some confusion here, likely caused by the large # of requests we’ve received related to the Sheriff’s department this past year. Apologies for any confusion – Please allow me to try to clarify:

Throughout 2018 we received and sent out numerous requests related to specific information about the Bunc. Co. Sheriff’s Office. We send each of the the requests individually, and perform periodic “Follow Ups” on each of those requests to receive confirmation that they were completed, denied, need additional clarification, etc.

It’s possible that not all of these requests have always included you in the CCs from the start, and I don’t think we started doing that until receiving Natalie Bailey’s auto-reply notifications that you should be contacted while they’re out of the office.

The particular request you’re replying to currently is a lengthy, multipart request we received in May 2018:

    Subject: “Buncombe County Sheriff’s Office”
    URL: https://www.sunshinerequest.com/records_request/buncombe-county-sheriffs-office/

    —————-
Beyond this particular request, here is a list of other “Open” or “Completed” requests we’ve sent related to information about the Sheriff’s Office. While several of the requests have similar titles (this is how they were received on our site), these are all individual, unique requests:

(Open – Message above ^) Buncombe County Sheriff’s Office
    (Open) Sheriff Dept employee salaries (July 1st 2016 – June 30th 2018)
(Open) Buncombe County Sheriff’s Office Sexual Assault Calls for Service

(Completed) Buncombe County Sheriff’s Reserve Deputy Policy
(Completed) Buncombe County Sheriff’s Office Personnel Advisory Board

For organization’s sake, we’d like to continue to follow up on those individually, in the email chain in which they were sent.
However, if you do decide to reply to any of these, outside of their respective email chains, we’d like to ask if you can please indicate the URL or the exact title of the request you’re referencing – this way we can make sure that there is not any confusion as to which request we’re updating.

    Sorry for the lengthy message.

We appreciate your continued assistance with the requests.

subject: Records Request: Buncombe County Sheriff’s Office

    Good Afternoon Buncombe County,

We recently received another request via www.sunshinerequest.com for information that may be available in your office.

    Here are the details:

    Subject: “Buncombe County Sheriff’s Office”

    Message:
“1. SECTION 1. Sec. 5.4 of General Assembly of North Carolina Session 2007 House Bill 1197 Ratified Bill that created the Personnel Advisory Board for the Sheriff’s Department of Buncombe County clearly states that “The secretary shall keep the minutes of the proceedings of the Board and shall be the custodian of all papers and records pertaining to the business of the Board, and shall perform such other duties as the Board may direct. All of the records of the Board shall be open to public inspection, during normal business hours at their place of keeping, except where otherwise prohibited by law.”

    A. How often does the Buncombe County Sheriff’s Office Personnel Advisory Board meet and who attends the meetings other than the Board members?

There is no section specifically under SECTION 2.(a) that exempts the Personnel Advisory Board minutes from public records.

    B. Please provide the public records of the Board and/or please provide certified confirmation that Board minutes have been taken and recorded, as required by law.

    2. The Buncombe County Sheriff’s Office 2015 Annual Report states that the sheriff’s office follows the Family Justice Center model for dealing with domestic violence calls.

    A. Please provide any and all statistics showing the model’s use and/or success and/or failure with the model.

    B. Please provide the number of domestic violence calls responded to for Sheriff Van Duncan’s entire tenure by year and the outcomes of those calls.

    3. The City of Asheville Police Department provides the public with records pertaining to employees who have been terminated.

    A. Please provide the same for the Sheriff Van Duncan’s entire tenure, including any law enforcement certifications Sheriff Duncan has revoked.

    Thank you.”

    Thank you for your help.
    Have a great day!
