Dismissed cases – Buncombe County

Hello,

We would like to know if any criminal cases were dismissed, prior to a first court appearance, as a result of The Buncombe County “Amnesty Day” on 1/25/19.

Specifically, we would like to know any cases that were dismissed which did not have orders for arrests related to them, and/or for which the first appearance in court had not yet occurred.

We would like to know the specific charge(s) and the reasoning justifying any dismissals.

Additionally, we would like to know if any cases that had associated victims (other than Society/State of NC) were dismissed and if the victims were notified or consulted with regarding the handling of the case.

Thank you.

Editor’s Note: Sunshine Request makes no claim as to the veracity of any statements or information contained in any of the requests, or public records, we receive.

Editor’s Note 04/30/19: Our apologies for the delay sending this request. We’ve clarified the request to say that the data requested should not include personally identifiable information (like names and case #s). If the sender requires that information as part of the request, please feel free to make a new request by contacting the Buncombe County DA’s Office directly. Thank you!

**Editor’s Note: Per Steven’s clarification on 05/06/19, the information found in the similar request to this one is the best they can do at this time. That request can be found here: https://www.sunshinerequest.com/records_request/dismissal-of-cases-on-buncombe-co-amnesty-day/

The previous information is the best we can do at this time due to the limitations of the data systems. Hopefully the state will fund a new system that will integrate many functions which should allow for more options.
