Number of Untested Rape Kits In Buncombe County North Carolina and their status

Hi, I would Like to know how many Rape test kits have been done at the Family Justice Center In Buncombe County in the last year and the status of each kit (i.e. conviction, no conviction or case closed). I would Like to see this data for the last 5 years.

I would also like to have the numbers for how many sexual assault cases were closed with no charges in 2017.

Sexual Assault Evidence Kits are performed by Mission Health Forensic Medical Exam Nurses at the Mission Health Forensic Medical Exam Clinic located at the Family Justice Center. All records are maintained by Mission Health and I would direct you to them.

    Good Afternoon,

     

    The Buncombe County Sheriff’s Office does not possess records responsive to your request requesting the number of “rape kits” conducted at the Family Justice Center.

     

    The Buncombe County Sheriff’s Office submitted the following information on December 7, 2017 to the State Bureau of Investigation (SBI) in accordance with a joint request made by the North Carolina State Crime Laboratory and the North Carolina Attorney General’s Office dated July 19, 2017.

     

    The Buncombe County Sheriff’s Office had 167 sexual assault evidence collection kits that had not been tested. Of those 167 untested kits:

     

    • four (4) were anonymous;

    • 24 kits involved cases that were adjudicated, and the defendant made a plea in court;

    • 15 kits involved defendants/suspects that admitted to engaging in intercourse in the course of the investigation process;

    • 31 kits were classified as “unfounded” due to the circumstances not meeting the statutory elements of a sex offense.

     

    Of the remaining 93 untested sexual assault evidence kits, the cases were presented to the District Attorney’s Office, but prosecution was declined due to the victim refusing to cooperate.
