Instead of providing the same answer for all of the questions I will sum up as follows. As provided in HB 1197 Sections 2(a) and 2(b) the Personnel Advisory Board is composed of members appointed by the senior regular resident Superior Court Judge of the 28th Judicial District. Any questions concerning the qualifications or appointment of board members should be referred to the appointing judge. The board is required to annually elect a chairman. Any requests concerning meeting minutes or board functions should be referred to the chairman. The board’s role is to advise the Sheriff on personnel matters so any communication from the board to the Sheriff would be part of a personnel record and not subject to public information laws.

Hi All,

In order to avoid causing any additional confusion, I’ll try to explain this as simply as possible.

Over the past 6 months or so Sunshine Request (www.sunshinerequest.com) has received and sent to Bunc. Co Gov and the Sheriff’s Dept. numerous requests varying in subject matter related to the Sheriff’s Dept. We are treating those all as individual and unique requests.

The specific request I’m contacting you about now is called “Buncombe County Sheriff’s Office Personnel Advisory Board” (For reference: https://www.sunshinerequest.com/records_request/buncombe-county-sheriffs-office-personnel-advisory-board/). This was sent in back in April.

There has been a bit of back and for about this and other requests related to the Sheriff’s department, which created some confusion on my part – I crossed up some wires thinking that Michael and Kassi were telling me to contact Julie Nicholson about this request, but that was my mistake. They were actually referring to something related to the Family Justice Center and a different request, which I did reach out to Julie about.

In my confusion, I also told Kassi and Michael that no additional assistance was needed for the Advisory Board request. However, in reviewing all the requests we have open just now, I realized that we do still need assistance, and would like to ask for follow up on this request. Here are the details:

Hi Kassi and Michael,

I thought it expedient to CC Julie and Natalie here again too, so we can get this resolved quickly and without additional confusion. I apologize for any miscommunication – and thank you for checking in. Yes I was trying to get a contact for FJC, but was able to obtain one through another source.

Although this request and email subject pertains to the Sheriff’s Office Personnel Advisory Board (https://www.sunshinerequest.com/records_request/buncombe-county-sheriffs-office-personnel-advisory-board/), I think I see what went wrong here – some wires got crossed in the process of receiving Natalie Bailey’s replies and her reply about FJC got mixed up within the her reply to the Advisory Board request.

We’ve received numerous Sheriff’s Dept. related requests recently, which have also been sent to Natalie, so we asked that she please reply to the exact request that was emailed, and indicate the correct subject line or URL pertaining to each one so that we can keep them all separate.

This request was sent to you and Michael in early May. After some back and forth it was determined that for Sheriff Dept. requests we should reach out to Natalie Bailey, which we did on May 11. We had several correspondences back and forth with Natalie, and after continuing to follow up on the status of the requests, were told that specifically for “metrics and statistics regarding assessments of the efficacy of this particular model in dealing with domestic violence” we should “Contact the Family Justice Center”.

I believe that what should have happened instead, is that we should have then broken that line out of this Personnel email, and instead emailed Julie N. about the request called “Buncombe County Sheriff’s Office Domestic Violence Calls for Service” found at

Or,

At this point, I have to assume that Natalie was referring to one of those two, but I’ll follow up with her to check. I don’t think that any additional reply is needed from yourself, Michael, or Julie related to the Advisory Board request, and I’ll reach out to Julie / Natalie about the other requests.
