Hello Henderson County, NC Sheriffs Office (or County Government),

I'd like to make a three part, public records request for the following information. Please provide the most responsive records as of 12/22/2020 (or the date the query is performed):

Please provide all current HCSO employee names, salaries, positions and titles, including Detention, Civilian, Narcotics, as of 12/22/2020 (or the date the query is performed). I will assume that certain employees will need to be redacted due to their position. Please include:

A. Name, Rank, and Salary

B. Current command structure within the agency.

There should be one more – the long one from our HR office of your request 1, below. When I have it, it’ll be on its way, but since the way NC in G.S. 153A-98 sets it up we provide “information” regarding employees, not “records”, and so we have to create the document providing the information (no software out there that says “here’s a report with the GS 153A-98 info”), and its take time when it can only be done around other work.

Of these 17 vehicles, 3 K9,

Fy20/21 is 17

Employee information requests regarding County government employees (which for this purpose includes employees of the Henderson County Sheriff’s Office) are governed by N.C. Gen. Stat. §153A-98.

Request 1:
I have forwarded the request for all Henderson County Sheriff’s Office (including Detention Center) (i) employee names, (ii) current salary, (iii) current position, (iv) title, as of the date(s) the information is complied. As you alluded to in your request, “position” and “title” will not necessarily reveal the duty assignment of the employee. In addition, you may (or may not) be able to deduce from the information provided the command structure of the Sheriff’s Office. However, the information that the County is allowed to provide is (as you will note from the statute) limited, and to provide other than that provided for in §153A-98 is, under §153A-98(e), a crime.

Request 2:
Unfilled positions and in what divisions in the Henderson County Sheriff’s Office: as you noted before, this isn’t really a records request, but it is also something that will be provided.

Request 3:
A. through D. Again, not a records request, but since it would not be very difficult to create one that would supply this information, I will try to secure it and provide it.

As to when these requests can be fulfilled, I cannot really say. My first thought is that requests 2 and 3 can be fulfilled pretty quickly – this week – but request 1 will take the County’s human resources department some time to compile, since the County’s payroll and personnel software does not keep the information the same way that §153A-98 allows it to be provided to the public. In any event, a copy of this email is being sent to the County’s Human Resources Department regarding Request 1, to the Sheriff’s Office regarding Request 2, and to the County’s Finance Department regarding Request 3.
