subject: Records Request: Dismissed cases – Buncombe County
Good Afternoon Buncombe County District Attorneys Office,
We received another request for info that may be available in your office.
Sunshine Request is trying to balance providing good data to the public, while minimizing the amount of personally identifiable information we publish as relates to criminal justice. Therefore, as relates to the request (below) we received, we’d like to ask that you please do not include any personally identifiable information (like names or case #s) in the results you send back. Thank you!
Here are the details:
Subject: Dismissed cases – Buncombe County
We would like to know if any criminal cases were dismissed, prior to a first court appearance, as a result of The Buncombe County “Amnesty Day” on 1/25/19.
Specifically, we would like to know any cases that were dismissed which did not have orders for arrests related to them, and/or for which the first appearance in court had not yet occurred.
We would like to know the specific charge(s) and the reasoning justifying any dismissals.
Additionally, we would like to know if any cases that had associated victims (other than Society/State of NC) were dismissed and if the victims were notified or consulted with regarding the handling of the case.
We appreciate your assistance,
