Good afternoon Lee County, NC Government and Sheriff's Office (Records Officer),

I'd like to make a multi-part public records request for the following information under NC Public Records Law.

B. Please provide any and ALL messages of any kind from any department issued devices assigned to Kevin Spivey and Lee Whitaker, sent or received from any contacts that include any portion of the following names:

    We can confirm that we conducted a review of our records and determined the records that were released were public records responsive to your request. Since public record requests are evaluated based on content, not sources, in this case, the content concerned an employee participating in an organization in his personal capacity. Unless the employee was directed to participate on behalf of Lee County Government or the Sheriff’s Office, there is not a direct link between the correspondence and the transaction of county business.     Thank you for your reply.

     

    Can you please confirm that you checked for all responsive records to the request related to public business specifically? I understand that some types of personal emails are not necessarily always a matter of public record… but they are not being requested in this case. Can you please further clarify the following:

     

    “… Any records between Officer Spivey and Officer Whitaker and any of the other listed individuals are not public records and instead are personal records of the individuals involvement with the nonprofit North Carolina School Resource Officer Association.”

     

    I am not aware of any statue that says emails exchanged between Government entities and non-profit organizations are exempt from public records law. Any communications sent to or from the Lee County, NC Sheriff’s Office and its employees on government email accounts, devices, etc., emails to and from Kevin Spivey ([email protected]), or Lee Whitaker ([email protected]), should be a matter of public record under the law.

     

    If you are unable to fulfill any / all portions of the original request, please specifically cite where a reason for the denial is justified under NC Public Records Law.
