(March 2020) Request related to “Seized Property” in City of Asheville and Buncombe County, NC for the last 5 years

Hello [City of Asheville - APD], [Buncombe County Sheriff's Office],

I'd like to make a public records request for the following information. The responsive records should include information during the time period of 03/01/2015 - 03/11/2020:

1. Please provide all internal policies for [APD] [BCSD] concerning seizing property of a person or business under civil forfeiture.

2. A list / dollar amounts of property / assets that were seized under these forfeiture policies and converted to the use of the [Police] / [Sheriff] for the past 5 years.

3. Please include all reports related to these seizures as well as associated information from the courts wherein the assets were forfeited.

Thank you for your assistance!

Editor’s Note: Sunshine Request makes no claim as to the veracity of any statements or information contained in any of the requests, or public records, we receive.

Please Note: Currently, we have 9 types of request statuses, indicated by various colorful “face icons” on the View all Requests page, as well as in the overall “Fulfilled Status” listed at the top of each request.

The overall “Fulfilled Status” of a request may not always match the individual statuses of a request’s various activities / updates listed below the request. For example:

If the same request was made to both Buncombe County and Asheville City Governments within one request, this is treated as two requests, and it’s possible that one entity’s request statuses could get marked as “Completed,” while the Overall Status of the request is still marked as “Government Processing Request.”

This just means that Sunshine Request is waiting on the rest of the results before we can mark the request as fully “Completed” overall.

If at any time you would like to track the status of your request, please search for your request via the “Search box” or list of requests on this page. Any updates we receive will be posted on our site as soon as we are able.

    Good afternoon Liz,

Thank you for all your help with this request! We have redacted the folder you sent to remove all the individual incident reports (9 documents), and have noted on the site that if anyone wishes to request those documents, they should contact the City directly for assistance. We will now mark this request as completed.

    Have a good day!

**Editor’s Note to sender 04/22/21: The referenced file has been redacted, and added to our documents section (above at top left): [Sunshine Request Copy – Redacted to remove incident reports] 2020-12-03-SeizedProperty

You can see from our previous correspondences with Liz that we realized many of the documents we received go against our Policies. Therefore, we have redacted the original file from Liz, to exclude the individual incident reports.

** Due to the personal nature of this type of information, we recommend that the sender reach out directly to the appropriate entity for assistance with the request if they wish to access the individual incident reports.

    Thank you for using www.sunshinerequest.com!

    Good afternoon Liz,

    Thank you for your reply!

It’s not so much a matter of whether we can redact the records you’ve provided or not. This type of information is not something we can fulfill as originally sent, and we’re basically just asking that the request we rewrote be resubmitted.

We will need time to consider our response, and will get back to you as soon as we can.

    Thank you!

    Good morning Sunshine Request,
I am unclear as to if you are requesting additional records for this request? The provided documents are the responsive to the request and all information included in them is public record. You are absolutely able to create a redacted version of the provided public records or create a new document based on these records to put on your website but as outlined in N.C. General Statute § 132-6.2 (e), we are not required to create a record that does not exist. If you’re not comfortable putting the provided records on your website, feel free to refer people directly to the public folder I have created.
    All best,

**Editor’s Note: We have to review the files over the coming weeks and will follow up with Liz at that time. Thank you for using Sunshine Request!

    Hi Liz,

I’m sorry it’s taken so long to review the files and follow up with you RE: “(March 2020) Request related to “Seized Property” in City of Asheville and Buncombe County, NC for the last 5 years”.

We really appreciate all the time it has likely taken you (and other records officers) to process the request!

The original request asked for Seized Property in the City of Asheville:

    “…. during the time period of 03/01/2015 – 03/11/2020:

    1. Please provide all internal policies for [APD] concerning seizing property of a person or business under civil forfeiture.

    2. A list / dollar amounts of property / assets that were seized under these forfeiture policies and converted to the use of the [Police] for the past 5 years.

    3. Please include all reports related to these seizures as well as associated information from the courts wherein the assets were forfeited.”

I’ve reviewed the files you sent over in December (not published on our site), and need to ask for some amendments to be made. It has been over a year since the request was first sent in, and we sincerely apologize for not catching this edit sooner:

We realized the files related to items #2 and #3 go against our policies about the types of info we will post on our site. Specifically, Sunshine Request will not fulfill: “Requests for public safety information specific to a single individual, address, incident or name. This includes police reports, calls for service, complaints / incident reports / citations, criminal / arrest type records, or camera footage. We will, on a case by case basis, fulfill public safety related requests that focus on system-level trends and data…”

With this in mind, we’d like to ask if it is possible for you to restart the process to fulfill an amended version of the original request? We’d ask that it should now read as follows, to exclude personally identifiable information such as name, address, case number, etc:

“Hello City of Asheville (and APD),

I’d like to make a public records request for the following information. The responsive records should include information during the time period of 03/01/2015 – 03/11/2020:

    1. Please provide all internal policies for [APD] concerning seizing property of a person or business under civil forfeiture.

    2. Please provide a list of dollar amounts, and dates of property / assets that were seized under these forfeiture policies and converted to the use of the [Police].

** Please do not include names, case numbers, addresses, or other personally identifying information. Sunshine Request will not publish those types of records on their site.

    Thank you for your assistance!”

    Good afternoon Liz,

We’re following up on this request that was sent in on March 19th: (March 2020) Request related to “Seized Property” in City of Asheville for the last 5 years

At this point there is no clarity on the request’s estimated completion date, or what is taking so long for the request to be processed. Can you please let us know what is the specific reasoning for the delay, and whether that’s on the City’s end, APD, legal, etc. and when it will be completed?

    We appreciate all your help,

    Hello Sunshine Requests,

Here is what we have on forfeitures. Sorry for my delayed response.

    1. Please provide all internal policies for BCSD concerning seizing property of a person or business under civil forfeiture.

We follow all state and federal laws regarding criminal and civil forfeiture, we do not have any additional internal policies regarding forfeitures.

Generally speaking the Buncombe County Sheriff’s Office has dealt with criminal forfeiture which is different from civil forfeiture.

The U.S. Department of Justice has a lot of information regarding the types of forfeitures on their website:

    www.justice.gov/afp/types-federal-forfeiture

The Guide to Equitable Sharing also goes into detail about asset forfeiture programs:

    www.justice.gov/criminal-afmls/file/794696/download

    2. A list / dollar amounts of property / assets that were seized under these forfeiture policies and converted to the use of the Sheriff for the past 5 years.

We do not have a list of property, but you can find detailed accounting of these funds in Buncombe County’s Comprehensive Annual Financial Reports. The specific information you are looking for is listed as the Drug Forfeitures Fund.

You will see multiple pages that reference the fund in the report, but page 118 has the numbers you are looking for in the FY 2019 report:

    3. Please include all reports related to these seizures as well as associated information from the courts wherein the assets were forfeited.

Criminal investigatory information is not public record in North Carolina per G.S. 132-1.4

We are not the custodian of court records, you would need to reach out to the U.S Attorney’s Office for court records or the federal agency that was involved. These court records are also available on https://pacer.uscourts.gov/.

Good afternoon Buncombe County Sheriff’s Department,

I work for a website called Sunshine Request www.sunshinerequest.com. We built a site that makes it easier to make public records requests by filling out a simple form, and the results of any requests are posted on our site. This allows citizens to learn more about our local government, while saving staff from having to fulfill duplicate requests. If you have any questions about the project, please let me know, and I’ll be happy to answer.

The below public records request was sent in on March 19th and we haven’t gotten an update from Aaron Sarver if it had been received and began processing or not. We called the Buncombe County Sheriff’s Department earlier this month and were told to send any Sheriff’s Department requests directly to you, Vicki Kuykendall. If this information is incorrect please let us know who the appropriate contact to send public records requests is and we will get in touch with them.

Please confirm receipt to let us know the request will begin processing, and if possible, please provide a rough estimate of when the request may be completed. We will plan on following up again around that time.

Here are the details of the request:

Subject: (March 2020) Request related to “Seized Property” in Buncombe County, NC for the last 5 years

Message: “Hello Buncombe County Sheriff’s Office,

I’d like to make a public records request for the following information. The responsive records should include information during the time period of 03/01/2015 – 03/11/2020:

    1. Please provide all internal policies for BCSD concerning seizing property of a person or business under civil forfeiture.

    2. A list / dollar amounts of property / assets that were seized under these forfeiture policies and converted to the use of the Sheriff for the past 5 years.

    3. Please include all reports related to these seizures as well as associated information from the courts wherein the assets were forfeited.

    Thank you for your assistance!“

** Sunshine Request makes no claim as to the veracity of any statements or information contained in any of the requests, or public records, we receive.

    Thank you for your help!
    Sunshine Request

**9/2/20 Editor’s Note: Today we called Buncombe County Sheriff’s Department to inquire if there was a better contact than Aaron for public records requests. They told us to send them to Vicki Kuykendall, Crime Analyst and Records Supervisor. We will be following up with Vicki next week on Sheriff’s Department related requests. Thank you for using Sunshine Request!
