(March 2020) Request to City of Asheville, Buncombe County Sheriff, and Buncombe County DA, for “Marsy’s Law” info

Hello [Buncombe County District Attorney's Office], [Buncombe County Sheriff's Department], [City of Asheville - APD],

I'd like to make a public records request for the following information:

Please list all operating procedures, orders, personnel changes, and internal policy changes that occurred to comply with Marsy’s Law or the Victims of Crime Rights Amendment that became Law in North Carolina on November 6th, 2018.

Provide those documents. And include the results of any compliance checks if any.

Thank you for your assistance!

Editor’s Note: Sunshine Request makes no claim as to the veracity of any statements or information contained in any of the requests, or public records, we receive.

Please Note: Currently, we have 9 types of request statuses, indicated by various colorful “face icons” on the View all Requests page, as well as in the overall “Fulfilled Status” listed at the top of each request.

The overall “Fulfilled Status” of a request may not always match the individual statuses of a request’s various activities / updates listed below the request. For example:

If the same request was made to both Buncombe County and Asheville City Governments within one request, this is treated as two requests, and it’s possible that one entity’s request statuses could get marked as “Completed,” while the Overall Status of the request is still marked as “Government Processing Request.”

This just means that Sunshine Request is waiting on the rest of the results before we can mark the request as fully “Completed” overall.

If at any time you would like to track the status of your request, please search for your request via the “Search box” or list of requests on this page. Any updates we receive will be posted on our site as soon as we are able.

    Hello Sunshine Requests,

This page on the Sheriff’s Office website lists the Crime Victims’ Rights as mandated by the constitutional amendment that passed in 2018:
    www.buncombecounty.org/governing/depts/sheriff/victims-rights.aspx

AOC form CR-180B, which lists the victims’ rights, should be provided to a victim within 72 hours of a victim being identified.
That document is attached, as is a document with the full list of crimes that require notification.

I believe this info fulfills the request.

    Aaron
