Please provide a report or list of annual salaries for all current “Full-Time” employees of Montgomery Community College, as of 03/06/2023 (or on the date the query is performed). Please include the following:

A) Employee Name
B) Current Job Title / Department
C) Current Annual Salary

Ideally, I’d like to receive the responsive records in an Excel format, if possible. If any / all of this info is already publicly available online, please provide a link to where it can be accessed.

    I’m still not sure that’s a clear enough / satisfactory explanation about fees…

    The fee was based on 2 hours of my salary to complete the report. I am a one-person Human Resources department, and thus my hourly salary rate was used to calculate the fee X 2 hours.

    Thank you for sharing that file, and thanks for “waiving” a fee. I will further review your email, and get back to you as soon as I’m able to complete the request.

     

    However, I would still like to ask that you please provide the additional clarification I’ve been asking for regarding fees. I’ve been asking for this info since your first email, and have not received a response. It is very likely that our Team will continue to receive or send future requests to your office — so I’d really like to better understand your organization’s procedures / policies for how you determine when fees may be applied.

The College will provide an estimate of the costs for an extraordinary request prior to making the records available for inspection or release and allow the requestor the option of either agreeing to pay the charge or revising the request to narrow its nature or scope.”

    At the time of my first message you had only indicated that “… Our staff assessed the cost and it will be $59.56 to produce the report you requested.”
    Can you please clarify exactly how much staff time you had originally estimated to “produce the report”, and what $ rate you used to make that calculation?

     

    Now that the request has been completed, you’ve said that approximately 2 hours were spent on the request. I’ll assume that means the “full labor cost of the person preparing the record” was $29.78 per hour?

     

    I’d also like to understand how you determine that a standard request for salaries is considered to be “extraordinary”? It’s been my experience that it’s standard practice with many entities in NC that only when an “extensive use of information technology resources or the labor costs of the personnel providing the services” might require 4 or more hours, that the request is considered “extraordinary” (or subject to a special service charge per hour for each hour in excess of 4 hours).

    We are attaching the information that you requested. Please understand that this is not a standard report and required about 2 hours of manual work to produce, which is how we calculated the fee. We have provided the report at no charge this one time, however future requests may have the fee imposed since it is not a standard report and has to be produced manually.

    The type of salary info I’ve requested (Employee name, Title, Salary) is widely regarded and consistently produced as a public record as part of the public personnel file of community college employees. Many community colleges around the state frequently fulfill a request like mine via email in 1 week, or in many cases 1 day.

     

    Per this note on MCC’s Public Records Request Form:

     

    “There is no charge for examining a public record, but there is a copy charge of $0.10 per page for any copies the College makes for the person/organization requesting the record. In addition, if the information request is for something other than a readily available document, the College will charge for the time it takes a staff person to collect or prepare the information. This charge is based on the full labor cost of the person preparing the record. The College will provide an estimate of the costs for an extraordinary request prior to making the records available for inspection or release and allow the requestor the option of either agreeing to pay the charge or revising the request to narrow its nature or scope.”

I’d also like to understand how you determine that a simple request for salaries is considered to be “extraordinary”? We find that typically, only requests that require 4 or more hours to prepare, constitute an “extensive use of personnel” or are subject to a special service charge per hour for each hour in excess of 4 hours.

    You can see a screenshot of the response message we received from their website, above in our “Documents” section (File Name:“Form submission message, 03/06/23, 1230EST”). As of 1:35pm EST there is no additional update to report.
