(October 2019) Request for City of AVL and APD employee military leave policies

Hello City of Asheville,

I would like to make a public records request for the following information about the City of Asheville’s (if applicable) as well as the Asheville Police Department’s military leave policy:

Specifically, I’d like to know how long a City employee is permitted to be employed in the military and stay employed by the City. I’d also like to know within what radius of the police department employees are required to live in order to remain employed.

The requested information should include any policies or relevant documentation of the City’s military leave policies from 10/01/18 - 10/02/19.

Thank you for your assistance!

Editor’s Note: Sunshine Request makes no claim as to the veracity of any statements or information contained in any of the requests, or public records, we receive.

Editor’s Note 10/03/19: As it was originally written, the request was a bit unclear and also included extraneous information that is not relevant to submitting a records request. It did not meet our standards for a request, and therefore has been rewritten to exclude the extraneous info.

Sunshine Request is run by a very small team. Some of our team are currently out of office this week. Upon their return next week, they will send in new requests as soon as is possible. Thank you for using Sunshine Request!

    Dear Sunshine Request:
The record responsive to your request is here. The Residency Requirement for all city employees is on page 15 and the Military Leave Policy is on page 23. There are no separate policies for police department employees.
The City of Asheville also follows USERRA, the Uniformed Services Employment and Reemployment Rights Act, a copy of which you can find here.
Please let me know if you have any questions.
