    Hi Ben,

     

    Happy Friday!

     

    Once again, we were prepared to mark this request as complete. However, we did catch one additional item that may need some clarification.

     

    Specifically the portion of the request that says, “(11) Date and type of each dismissal, suspension, or demotion for disciplinary reasons taken by the municipality. If the disciplinary action was a dismissal, a copy of the written notice of the final decision of the municipality setting forth the specific acts or omissions that are the basis of the dismissal.”

     

    Since Frost’s personnel record you provided does indicate he was dismissed in 2014, we’d like to request “a copy of the written notice of the final decision of the municipality setting forth the specific acts or omissions that are the basis of the dismissal.”

    I’ve been informed that only employees appointed by the city council work under contract. These employees include the City Manager, City Clerk, and City Attorney. As such Robert Frost does not have a contract to provide.

    I marked this request as complete – thank you again for your help. We’ve actually just received another new request for additional information related to Robert Frost. We will consider this new request to be a clarification on the original request related to Robert Frost.

    I would like to request further clarification on the sender’s behalf – I’m unaware of the context for why they believe Mr. Frost was reinstated. However, I’m going to assume that their interest comes from mentions of his reinstatement in several Citizen Times articles:

     

    1. CT, 3/3/18 “The board was created by a state law specific to Asheville and is not common in most cities. It has the power to overturn firing decisions, as it did in the 2014 case of officer Robert Frost, who was terminated by then-police chief William Anderson for using excessive force against an intoxicated woman in handcuffs.”
