I received your Next Request message (June 28, 12:46AM) via email, notifying that many documents for “record request #24-2” were uploaded to Next Request. I also received the email you sent above (12:49AM) which includes a Google Drive link to some of those same files.
I tried clicking the documents linked in your Next Request email, but it isn’t possible to open them. Since you set up the account for us, I reset my password so I could try to login and view the files. I am able to “sign in”, but only right after resetting the password. It’s not possible to sign in simply by entering my login info.
In any case, there isn’t a request or any documents to be viewed whenever signed in. Overall the Next Request platform seems to not be set up on the Iredell-Statesville Schools’ website.

Here is the estimated timeline for completing the request. Files have been placed in the Google Drive folder. It looks like the HTML files are not transferring through, so I’ve issued you an account through NextRequest to view these released records. I will be releasing records weekly as we continue to review them.
Since we have over 11,000 items, I believe I can set the anticipated completion of your request to August 16, 2024. Please note that some of these items may not fit the parameter of the information request. We are using a new software to help with our request and each image that is embedded into the email may come through as a separate file.

I just meant I would need time to speak with my Team to review what you said back on 05/17 (where you acknowledged Mr. Howell’s conduct specifically). I spoke with my Team earlier this week, and we determined we don’t have anything else to say on the matter.

On 05/17 you also said that “… We are working to go through these emails. To show the progression of this request, we will be releasing a portion of these emails as we work through the massive task of reading and redacting. I have created a Google Folder to house these files. I have attached the folder here. Next week I will put together a timeline so that you can know when to expect a series of emails to be available.” So, that’s what I was following up with you about again on 05/28.
In regard to the special service charge you’ve just mentioned today:
I appreciate your efforts to narrow the scope of my request. However, I (the requester) do not wish to narrow or further clarify the request I submitted to you in December. The keywords I requested are: “technology” , “tech” , “fee” , “device” , “tablet” , “iPad” , “Ipad” , “ipad” , “laptop”.
At no point since my request was submitted on December 14, 2023 have I ever been notified of a potential fee for this request. In fact, I didn’t receive any acknowledgement that you were even working on the request at all until February 22: “… I want to apologize for the lack of response. We have received your request and will work to expedite the fulfillment of the request. While this is no excuse, we have identified the gap in our process and are working to ensure our compliance with the Law. I will provide an update on the timeline via email by 2/26/24. This will provide time for us to pull the records and figure out how much estimated time we will need to review and redact anything necessary.”
On February 26, you said: “… At this time we have pulled over 7000 items to review and potentially redact on this request. We will begin going through these items.” Since that time (and prior to Mr. Howell’s email) I’ve been asking for an update as to when you anticipate the request may be completed. All communications we’ve exchanged to this point have indicated that you were working to fulfill my request. I’m very surprised to learn nearly 6 months after submitting the request, that you’d now like to assess a special service charge.
By Law you cannot charge for the time spent to redact or separate confidential from non-confidential information. You have already established that you searched for and identified the number of responsive records — therefore, it would be very helpful to me if you provide a clear explanation / cost breakdown of the dollar amount you think is required for this request. Also, please provide me with a copy of your policy for implementing a special service charge (how it’s calculated and when it’s used) for public records requests.

I wanted to seek some clarification. Your last messages indicated that you would review this with your team and provide a more detailed response on 5/17. I thought we were to wait for a response before going any further. As we have continued to analyze your request, the total amount of records continues to climb to over 11,000 items. We have spoken with our attorney for guidance in complying with your request. We are going to have to activate a special service fee to complete this large request. We are currently working to revise some of the keywords to see how many emails this would impact to see if the requester would like to edit the original request.
If we pull out the word “tech” it would reduce the number of emails down to a little over 8,000.
If we pull only the keywords “tech fee” it would reduce the amount of emails down to 20 emails.Please let us know the direction you would like us to continue with and we will provide an estimated cost, if any.

My name is Patrick Conant, and I am the Director of Sunshine Request (www.sunshinerequest.com).
Sunshine Request has been operated by my small team in Asheville NC since 2017, and we’ve submitted over 2,300 public records requests to government entities across the country. Our primary goal is to make it easy for any member of the public to access public records.
Your PIO, Jada Jonas, has also fulfilled previous public records requests we’ve submitted to Iredell-Statesville Schools.
NC Public Records Law does not require anyone requesting public records to provide their name, address, or intention when submitting a public records request. Furthermore, NC Public Records Law is quite clear that “people may obtain copies of their public records and public information free or at minimal cost unless otherwise specifically provided by law”. My team is very familiar with provisions of NC Public Records law that allow fees to be charged for physical copies or through a “special service charge”. However, since the public records we’ve requested should be readily available and we’ve requested electronic (rather than physical) copies, I do not expect there will be any fee assessed for the request we submitted to Iredell-Statesville Schools.
I want to express my concern with Mr. Howell’s insinuation that Sunshine Request is a secret organization, that we seek to “cause trouble”, and that people submitting public records requests are “terrorists”. This aggressive response to a member of the public exercising their right to request public records is highly inappropriate, particularly because Mr. Howell serves as Chair of the Board of Education.

I submitted the following public records request to I-S Schools on 12/14/2023 at 7:09pm, via your Public Records Requests online form:

Under NC Public Records Law, I-S Schools is required to “promptly” process all public records requests. Essentially, this means that if you intentionally delay the fulfillment of my request by allowing it to “sit” until staff has availability to address it, or feels like answering my emails, then this could be considered a denial of a request. With this in mind, I want to highlight again the court case referenced in item #6 of the following article, posted on the NC Press Association website.
